Payment Terms and Conditions
All Fees, assessments, dues, charges or other sums due from members to the Association shall become delinquent if not paid within 30 days after their due date. Such delinquent charges shall be cumulative and shall be a lien against any funds to which the stockholder shall be entitled upon sale of his/her stock certificate. Nothing in the foregoing shall be construed to prevent the Association from instituting proceedings in civil court to sue for payment of monies due. Dues not paid in full by April 30, 2023 will result in termination of membership and forfeiture of the members stock.
In the future should we decide to cancel our membership, we agree that we have 1 year from the date of request to return a signed stock waiver form and request a stock refund. If signed form is not received in a timely manner, any stock refund owed will be null and void.

Our family and all guests agree to abide by the pool rules and regulations posted at the pool and on the pool website, www.hamptonpool.org. We understand that violations of the pool rules and regulations can result in sanctions up to and including immediate and permanent termination of membership.

ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY

Hampton Pool Association, Inc. (“the Club”) has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I/we acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I/we understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
In addition to Covid-19 exposure I/we voluntarily agree to assume ALL of the risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I/we or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programming (“Claims”). On my/our behalf, and on behalf of my/our children, I/we hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto for any past, present or future injuries, claims or occurrences at Hampton Pool. I/we understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, past, present or future.
I/we acknowledge and agree that the Club may revise its procedures at any time based on updated recommended guidelines and protocols issued by the Public Health Agencies and further agree to comply with the Club’s revised procedures prior to utilizing the facilities. I/we further attest that I/we am/are not experiencing any symptoms of illness such as a fever, cough, or shortness of breath. If I/we develop any of these symptoms at a later time, I/we agree that I/we will not enter the Club.

We also agree that images and photographs and video of people and events at Hampton Pool that show myself or my family members may be used without permission for Hampton Pool Web/Social Media. I can request in writing to have any images I do not wish to be posted to have myself or my family member blurred out.

I/WE HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK AND WAIVER OF LIABILITY. I/WE ALSO UNDERSTAND THAT THIS ASSUMPTION OF RISK AND WAIVER IS MADE ON BEHALF OF MY MINOR CHILD(REN), SPOUSE OR ANY ADDITIONAL MEMBER ON MY ACCOUNT. I/WE REPRESENT AND WARRANT TO THE CLUB THAT I HAVE FULL AUTHORITY TO SIGN THIS WAIVER ON BEHALF OF SUCH MINOR(S), SPOUSE OR ANY ADDITONAL MEMBERS ON MY ACCOUNT AND ASSUME FULL LIABILITY AS SUCH
